Article 1 - Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer can exercise their right of withdrawal.

Consumer: a natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.

Day: calendar day.

Long-term transaction: a distance contract concerning a series of products and/or services, with delivery and/or performance obligations spread over time.

Durable medium: any medium that enables the consumer or entrepreneur to store information that is personally addressed to them in a way that allows future consultation and unchanged reproduction of the stored information.

Right of withdrawal: the possibility for the consumer to cancel the distance contract within the cooling-off period.

Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers.

Distance contract: a contract in the context of a system organized by the entrepreneur for remote sale of products and/or services, in which only one or more remote communication techniques are used to conclude the contract.

Remote communication technique: a means that can be used to conclude an agreement without the consumer and the entrepreneur being in the same room at the same time.

General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 3 - Applicability

These general terms and conditions apply to any offer by the entrepreneur and any distance agreement and orders between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the distance contract is concluded that the general terms and conditions are available from the entrepreneur and will be sent to the consumer free of charge upon request.

If the distance contract is concluded electronically, the text of these general terms and conditions can, deviating from the previous paragraph, be made available electronically to the consumer in such a way that it can be stored easily on a durable medium.


Article 4 - The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer.

The offer is non-binding. The entrepreneur has the right to modify and adjust the offer.

The offer includes a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to allow a good assessment by the consumer. If the entrepreneur uses images, these are a truthful representation of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the entrepreneur.

All images, specifications, and details in the offer are indicative and cannot be a reason for compensation or dissolution of the agreement.


Article 5 - The Agreement

The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and fulfills the conditions set forth in the offer.


Article 6 - Right of Withdrawal

When purchasing products, the consumer has the possibility to cancel the agreement without stating reasons within 30 days. This cooling-off period starts on the day after the consumer receives the product or a representative designated by the consumer.


Article 7 - Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the costs of returning the products are entirely the responsibility of the consumer.


Article 8 - Exclusion of Right of Withdrawal

The entrepreneur may exclude the consumer's right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal applies only if the entrepreneur has clearly stated this in the offer or before the agreement is concluded.


Article 9 - The Price

During the validity period mentioned in the offer, the prices of the offered products and/or services will not be increased, except for price changes resulting from changes in VAT rates.


Article 10 - Conformity and Warranty

The entrepreneur ensures that the products and/or services meet the agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability, and the applicable legal provisions and/or government regulations on the date of conclusion of the agreement.


Article 11 - Delivery and Execution

The entrepreneur will take the greatest care in receiving and executing orders for products.


Article 12 - Long-Term Transactions: Duration, Cancellation, and Renewal

Cancellation
The consumer can cancel an agreement that is entered into for an indefinite period and involves the regular delivery of products or services (including electricity) at any time, respecting any agreed cancellation rules and a notice period of no more than one month.


Article 13 - Payment

Unless otherwise agreed, amounts owed by the consumer must be paid within 7 days after the cooling-off period as described in Article 6, paragraph 1.


Article 14 - Complaints Procedure

Complaints about the execution of the agreement must be submitted within 7 days in full and clearly described to the entrepreneur after the consumer has noticed the deficiencies.


Article 15 - Disputes

Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply. This also applies if the consumer resides abroad.
